Silver v. Lavandeira - Perez Hilton Wins Again

Perez Hilton is involved in a multitude of lawsuits at any given time, and sometimes I know more about them than I really should....purely for legal purposes I assure you.

 

On July 22, 2008, Elizabeth Silver, a blogger who, I presume, is responsible for the majority of the content on the website PerezRevenge.com, filed suit against blogger Mario Lavandeira (aka Perez Hilton), who operates the website perezhilton.com, for copyright infringement, violation of the Digital Millenium Copyright Act, and other claims.

Silver claimed that Perez took content, facts, and other information, which was initially posted on the website PerezRevenge.com, and posted the same or similar enough content on perezhilton.com.

On January 7, 2009,  a magistrate judge issue a Report and Recommendation rejecting Silver's claims, stating that facts are not protected by copyright law, and dismissed the two DMCA violation claims.  Ms. Silver then filed for voluntary dismissal of the case.
