The U.S. Copyright office has published the terms of the 4 agreements between Soundexchange and webcasters in relation to the amount of royalties due for use of music online.


Domain Tasting all but wiped out...says ICANN

In 2008, ICANN took serious steps to limit domain tasting, including research, studies, and a poublic comment period..  This all resulted in two provisions.  In June 2008, ICANN approved the AGP Limits Policy and in June of 2008, the ICANN Board approved the FY2009 Budget, both of which approved and contained provisions dealing with costs associated with AGP (Add Grace Period) deletes.  ICANN now reports that domain tasting is now down or decreased 99.7%.


Websites, businesses, and and everyone beware, Maine has recently enacted (June 2, 2009, so not that recent, but recent enough)a new law entitled "Act to Prevent Predatory Marketing Practices Against Minors (L.D. 1183)" that monitors and prevents the marketing to and collecting of personally identifiable information (PII) to minors.


RealNetworks, Inc. and RealNetworks Home Entertainment, Inc. (we'll just call them RealNetworks, because in reality, they are one in the same) released for sale a software package named RealDVD in September of 2008.  By September 30, 2008, we were in court, with RealNetworks suing for Declaratory Judgement.  On August 11, 2009, the court released its decision in favor of the Movie Studios, but for those that would like to back up their DVDs, a glimmer of hope remains.


On March 08, 2007 i4i sued Microsoft in the United States District Court for the Eastern District of Texas for patent infringement.  The judgement came back on August 11, 2009, and it didn't look good for Microsoft.


Accusearch breaches PIPEDA, Canadian Privacy Law, helped out by FTC

With help from the FTC, Canada's Office of the Privacy Commissioner found that Accusearch, Inc, an online background investigation firm, violated PIPEDA (Personal Information Protection and Electronic Documents Act), Canada's privacy law.

Congress, under the Amercian Recover and reinvestment Act (ARRA, Pub. L. No. 111-5), has linked stimulus incentives to help doctors and health care providers implement electronic health recrods, to stricter security and privaacy rules.


DMCA Copyright Agent Interim Designation Fee Increase

I haven't seen this reported, announced, or even alluded to anywhere else.  In doing some standard work for a new client, we were registering their DMCA Agent. And then I came across this:


Lawmakers are growning increasingly frustrated with the file sharing networks and their constituents.  Lost taxes, more lawsuits, and overall, a complete upheaval fo our current structure.  When lawmakers are frustrated, they do what they do best, make laws in hopes of fixing the problem.  "The file-sharing industry has shown that it is unable or unwilling to ensure users' safety, and it is now time to put a referee on the field to ensure they play by the rules," said Edolphus Towns (D-N.Y.), chairman of the House Committee on Oversight and Government Reform.


Cloud E-Mail = Stored Communications Act free pass

In United States v. Weaver, the U.S. District Court for the Central District of Illinois held July 15 that e-mails which have been opened and kept on a web based e-mail service (can we think of one..AOL? Yahoo? Gmail?) which the recipient does not download (I thought that was the purpose of web-based e-mail...so we didn't have to download it), do not qualify as backup copies and therefore are not protected under the Stored Communications Act.
