Judge Davis decliared a mistrial in Capitol v. Thomas.  In October 2007, Jammie Thomas was ordered to pay the RIAA $220,000 in restitution to the RIAA, at the maximum penalty of $9,250 per song, and was said to have "made available" 1700 songs.
